We Help You Prepare Your F-1 RFE (Request For Evidence)

One Deadline One Complete Response

Your notice has a deadline printed on it, and extensions are rarely given. Your attorney decides what USCIS is asking for. We collect every document it names and organize the reply, so nothing in the request goes unanswered.

The Clock Is Shorter Than It Used to Be

An RFE is a written request from USCIS for specific additional evidence. The most common mistake is answering a different question from the one the notice actually asks. Under current USCIS policy, response windows can be shorter than before, and extensions are generally not granted.

That is where Omar & Co Consulting helps. We break your notice down item by item, gather and organize exactly what USCIS asked for, and add nothing it did not. An independent, licensed attorney then reviews and files your response.

Send us your notice the day it arrives. The sooner we start, the more of your window goes to building a strong response instead of chasing paperwork.

An RFE Still Leaves the Door Open

USCIS sends three kinds of letter and they are not the same. If you are holding one of the other two, your window is shorter.
Notice Received

Send us the notice the day it arrives. The deadline on it decides everything that follows.

Notice of Intent to Deny (NOID)

USCIS is leaning towards no and is giving you one chance to change that. Shorter window, higher stakes.

Denial

The decision is made. A motion, an appeal or refiling may still be open, each on its own short deadline. Speak to a licensed attorney today.

USCIS Only Sees What You Send

The officer deciding your case never meets you. They work from the file in front of them, and an RFE is usually your one chance to add to it. A reply that misses an item can be treated as no reply to that item, and the decision goes ahead on what is already there.

It works the other way too. When required evidence is missing from the start, USCIS can now refuse without sending an RFE at all, so your first filing deserves the same care as your response. This is where we come in. Your attorney decides what the notice requires, and we go and get it: transcripts from your university, financial records, whatever the list names, indexed against each item so the officer can find it.

Questions Before You Get Started?

Is an RFE a denial?
No. An RFE is a written request from USCIS for more evidence before it decides your case. It is not a decision, but you must respond completely and on time, because the outcome depends on what you send.
Generally, no. The deadline printed on your notice is firm, and extensions are rarely granted, so start as soon as your notice arrives. Your attorney can advise on your specific deadline.
Common requests include transcripts, financial records, proof of status history, and documents from your university. Your notice lists exactly what USCIS wants, and we collect and organize each item for your attorney’s review.
An independent, licensed immigration attorney reviews and files it. We gather and organize your documents, but we do not file on your behalf or give legal advice.
USCIS may deny your application for abandonment or decide it on the existing record, with no further chance to add evidence. If you have missed a deadline, contact a licensed attorney immediately to discuss your options.
